The 1, 2, 3s of CBD --- Part One

So you’re interested in CBD, huh? That’s great -- and you are not alone. Millions of people worldwide have either started or are interested in using this amazing, naturally occurring medicine to relieve their pain, calm their anxiety, curb their seizures, and more than a dozen other ailments.

But like most people toeing the water of CBD remedies, you are no doubt skeptical of what many call a “miracle drug.” So we’ve put together a little fact sheet here for you for the journey. It will include the basic descriptions without getting too technical, explain some of the laws you’ll want to know, and brief explanations about why CBD combats certain ailments and not others.

Our goal here is not to sell you a product (OK, it’s not our main goal), but rather provide the material you need to make informed decisions about CBD. So what is CBD?

CBD is short for Cannabidiol, which is one of the four main cannabinoids found in of the hemp plant. The other main part, tetrahydrocannabinol, aka THC, is the more celebrated cannabinoid due to the psychoactive properties. In total, there are 113 cannabinoids found in the hemp plant, many of which are naturally produced in the human body.

Basically, THC makes you feel “high,” while CBD makes you feel better. There are medical benefits to both THC and CBD, although the latter has a vast amount more. In fact, researchers are just scratching the surface of CBD’s potential.

CBD gets its medicinal properties from the fact that it binds to other endocannabinoids in the human body. That basically activates your body’s cannabinoids to reach a new, more robust potential. For explanations sake, it’s sort of like activating stem cells to do more than they are designed to do through unlocking their stored potential.

Sorry for all the science, but it’s important to know the basics of CBD. There have been “snake oil” salesmen for hundreds of years pedalling their “miracle drugs.” Well, CBD may be a miracle drug, but it also has scientific backing and both empirical and anecdotal evidence behind the claims.

Is CBD legal?

For the most part (we’ll get to that below), CBD is legal in all 50 states. In fact, because it does not get you “high,” you can buy it over the counter and online. Unlike THC, which is federally illegal, yet legal for those with medical needs in 31 states, CBD is legal nationwide. In May 2018, the U.S. Drug Enforcement Agency said that as long as the CBD extracts contain less than .3 percent THC, it is considered legal under the U.S. 2014 Farm Bill.

So if you’re worried about the legalities of CBD, you can relax. We can’t say all CBD producers are selling CBD oil that fit these federal guidelines, but we can say with certainty it would be bad-business to do so. At Divine Elements, all our products are thoroughly checked and rechecked to meet federal standards.

So, in June 2018, the Arizona court system threw a little wrench in the system. A controversial state appellate court decision called into question the semantics between the state’s medical marijuana law. In a split decision, the court determined that there was no stipulation between physical “flower” marijuana and oil-based extracts often used in vape pens.

Essentially, any oils extracted from hemp were not legal -- although flower was. Unfortunately, since all CBD is oil-based, it was swept up in the decision.

But don’t worry Arizona CBD users. We’ve spoken to local, state and federal law enforcement officials off the record. We’re close to all the medical marijuana journalists in the state. They all say you have nothing to worry about. Law enforcement is not busting down dispensary doors and confiscating oil-based THC and CBD products. And not only that, if you don’t need a card to get what you need -- and you don’t need one to get CBD -- law enforcement is NOT going to do anything.

Still not convinced? Well, a similar situation happened in Indiana. Here’s the response from the DEA:

"It would not be an appropriate use of federal resources to go after a mother because her child has epileptic seizures and has found something that can help and has helped. Are they breaking the law? Yes, they are. Are we going to break her door down? Absolutely not. And I don't think she'll be charged by any U.S. Attorney," said Rusty Payne, DEA spokesperson.

So this is where everything gets tough. How can we explain ALL the ways CBD can help you and your family? Seriously, we were super skeptical about all of this -- and yet not a day goes by that we don’t hear about how CBD oils have helped people with their medical issues.

And what we found out a few years ago is that the benefits are not just reserved to humans. Pets, especially cats and dogs, have displayed the same benefits by using CBD oils in their diets. There is plenty of anecdotal evidence of young dogs no longer chewing up shoes and furniture while their owners are away. Cats and dogs near the end of life have been helped with pain relief issues as well.
